勞務派遣工有可能轉成正式工嗎?

現在很多企業(ye)為(wei)了節省人力成本,會采用(yong)勞務派遣的(de)方式(shi)進行(xing)用(yong)工(gong)。尤其是(shi)(shi)國企一(yi)類的(de)機關(guan)單位,更(geng)喜(xi)歡通過勞務派遣的(de)方式(shi)進行(xing)雇員(yuan)。因此很多勞務派遣的(de)員(yuan)工(gong)就比(bi)較關(guan)心,自己作(zuo)為(wei)勞務派遣用(yong)工(gong)畢竟不是(shi)(shi)很穩定(ding),是(shi)(shi)不是(shi)(shi)可以從勞務派遣轉(zhuan)變成正式(shi)員(yuan)工(gong)?
從(cong)原則上來(lai)講(jiang)勞務派遣工(gong)可以轉(zhuan)成(cheng)正(zheng)式工(gong),但是轉(zhuan)正(zheng)機(ji)會很(hen)小。一般來(lai)說(shuo),100名勞(lao)務(wu)派遣(qian)工,也就有1人可以轉正,概(gai)率也(ye)就1%左右。為(wei)何(he)勞(lao)務轉(zhuan)正概(gai)率這么小呢(ni),主要原因有以下3點:
1. 勞務派遣崗(gang)位可替(ti)代性強。因為勞務派遣的(de)(de)崗(gang)位必須符合臨時性、輔助性、替(ti)代性的(de)(de)特點(dian)。其(qi)中(zhong):對于臨時性崗(gang)位,在用工單位連續工作時間不超過(guo)6個月;對于(yu)輔(fu)助(zhu)性(xing)(xing)崗(gang)(gang)(gang)位(wei)(wei)(wei)(wei)(wei),不能(neng)在(zai)用(yong)工(gong)(gong)(gong)(gong)單(dan)位(wei)(wei)(wei)(wei)(wei)主營業務(wu)崗(gang)(gang)(gang)位(wei)(wei)(wei)(wei)(wei)工(gong)(gong)(gong)(gong)作(zuo)(zuo),只(zhi)能(neng)為其提(ti)供(gong)相關輔(fu)助(zhu)性(xing)(xing)的服務(wu)工(gong)(gong)(gong)(gong)作(zuo)(zuo);對于(yu)替(ti)(ti)代性(xing)(xing)崗(gang)(gang)(gang)位(wei)(wei)(wei)(wei)(wei),主要(yao)是指用(yong)工(gong)(gong)(gong)(gong)單(dan)位(wei)(wei)(wei)(wei)(wei)的職工(gong)(gong)(gong)(gong)因脫產(chan)學習、休假等原因在(zai)該工(gong)(gong)(gong)(gong)作(zuo)(zuo)崗(gang)(gang)(gang)位(wei)(wei)(wei)(wei)(wei)上無法工(gong)(gong)(gong)(gong)作(zuo)(zuo)的一定期間內,可以(yi)由被(bei)派遣勞(lao)動(dong)者替(ti)(ti)代工(gong)(gong)(gong)(gong)作(zuo)(zuo)。因此,勞(lao)務(wu)派遣工(gong)(gong)(gong)(gong)對于(yu)企業的重(zhong)要(yao)程度比較低(di),工(gong)(gong)(gong)(gong)作(zuo)(zuo)的崗(gang)(gang)(gang)位(wei)(wei)(wei)(wei)(wei)都不是核(he)心崗(gang)(gang)(gang)位(wei)(wei)(wei)(wei)(wei),所(suo)以(yi)沒有(you)轉(zhuan)正(zheng)的必(bi)要(yao)性(xing)(xing)。
2.用工單位轉正名額少。一般來說(shuo),之所(suo)以用勞(lao)務派遣(qian)人員,很大(da)一部(bu)分原因是編制有限。因此,對(dui)于一些(xie)大型(xing)國(guo)有企業和(he)事業單位(wei),即便是提供轉正機會,名額也是有限的(de)。
3.國(guo)家沒有明確政策要求勞(lao)務(wu)派(pai)(pai)(pai)(pai)遣(qian)工(gong)(gong)必須轉(zhuan)(zhuan)正。在《勞(lao)動合同法》中(zhong),雖然明確提出了對(dui)被派(pai)(pai)(pai)(pai)遣(qian)勞(lao)動者與本單位(wei)同類(lei)崗位(wei)的勞(lao)動者實行同工(gong)(gong)同酬,但是(shi)我國(guo)的法律中(zhong),并未(wei)將勞(lao)務(wu)派(pai)(pai)(pai)(pai)遣(qian)工(gong)(gong)轉(zhuan)(zhuan)正作為強(qiang)制性要求。因此,很多用工(gong)(gong)單位(wei),對(dui)于勞(lao)務(wu)派(pai)(pai)(pai)(pai)遣(qian)工(gong)(gong)的管理,屬(shu)于用而(er)不轉(zhuan)(zhuan)的狀(zhuang)態。
